As this develops, it’s difficult to ignore the conflict between the administration’s professed objectives and the short-term legal ambiguity it has caused. Legal experts’ advice to businesses is pretty straightforward: don’t assume anything has changed yet. State laws are still in effect. In eighteen months, it’s possible that the situation will look completely different. The cleanest solution would be for Congress to formally preempt state frameworks through national AI legislation, but it’s still unclear if this will happen through years of litigation. Neither result is assured.
In the bigger picture, the nation is genuinely unsure of who should control its most important technology. The federal government has stated its stance clearly. The states aren’t quietly retreating. The companies that are actually developing and implementing AI systems are left to read court documents and rewrite compliance checklists in the middle of that dispute, hoping that things will settle down quickly.
