<p>The U.S. Department of Justice made an <a href="https://creativelearningguild.co.uk/celebrities/is-manon-still-in-katseye-after-the-shocking-hiatus-announcement/" type="post" id="6542">announcement</a> on a Friday afternoon in April that was unprecedented, at least not quite like this. One of the world&#8217;s oldest and most well-known tech companies, IBM, consented to pay the <a href="https://creativelearningguild.co.uk/news/khp-unconstitutional-traffic-stops-federal-court-confirms-violations/" type="post" id="4467">federal government</a> $17,077,043 to <a href="https://creativelearningguild.co.uk/health/mhcc-class-action-settlement-2-8-million-patients-had-their-data-stolen-twice-heres-how-to-claim-your-share-of-14-million/" type="post" id="8609">resolve claims</a> that its diversity, equity, and inclusion policies had gone beyond the law. After signing, the money had to be paid within 14 days. No lengthy payment schedule. No protracted discussion. Just a check, and the DOJ made it very evident that this was the first settlement of its kind.</p>



<h3 class="wp-block-heading">As this develops, there&#8217;s a sense that something changed, not just for IBM but for the whole network of big businesses that have spent the last ten years developing DEI infrastructure with the assurance that it was both legally sound and publicly anticipated.</h3>



<p>The DOJ&#8217;s <a href="https://creativelearningguild.co.uk/news/apsana-begum-council-flat-controversy-reignites-housing-debate/" type="post" id="4605">Civil Rights Fraud</a> Initiative was established in May 2025 with the express purpose of combating what Acting Attorney General Todd Blanche called &#8220;repackaged as DEI.&#8221; The settlement was the first settlement under this initiative. The False Claims Act, a piece of Civil War-era legislation intended to prevent defense contractors from selling the Union Army defective equipment, was the legal instrument employed. Its application here, aimed at the workforce diversity initiatives of a tech giant, is startling in the best way. It causes you to pause and reevaluate the true scope of that outdated statute.</p>



<p>It&#8217;s worth taking a moment to consider the specific accusations made by the government against IBM. The DOJ claims that IBM employed a &#8220;diversity modifier&#8221; that linked bonus payments to whether the business was meeting specific demographic goals. There were purportedly &#8220;diverse interview slates&#8221;—that is, the pool of applicants for employment, promotion, or transfer was influenced by sex and race standards. Additionally, IBM allegedly created demographic goals by business unit and targeted particular employees with leadership development opportunities, mentorships, and training programs based on their sex or race. The final section—the notion that access to professional development was being filtered through identity categories—is where the real-world effects on specific employees become most evident and unsettling to consider.</p>



<p>IBM denied that any of this amounted to illegal activity. The settlement agreement made it clear that neither IBM&#8217;s liability nor the government&#8217;s acceptance of the veracity of its claims were acknowledged. A representative for IBM stated that the company is &#8220;pleased to have resolved this matter&#8221; and that having the right people with the right skills is the guiding principle of their workforce strategy. It&#8217;s the kind of measured, cautious corporate language that doesn&#8217;t reveal much. Early cooperation with the investigation, disclosure of pertinent information, and voluntary corrective actions, such as changing or discontinuing the programs in question, were all provided by IBM. They received credit for their cooperation, which is probably one of the reasons the final figure came to $17 million instead of a much higher amount. The government may pursue up to three times the actual damages under the False Claims Act.</p>



<h2 class="wp-block-heading">IBM DEI Settlement: $17 Million, a Landmark Case, and a Warning Shot Across Corporate America</h2>

<p>IBM&#8217;s swift and <a href="https://creativelearningguild.co.uk/finance/powerschool-lawsuit-what-the-17-25-million-settlement-means-for-students-and-schools/" type="post" id="8063">cooperative settlement</a> may reveal more about the state of the law than it does about any sincere admission of misconduct. Since Trump issued executive orders in January 2025 requesting federal contractors to discontinue such programs, a number of major corporations have already discreetly reduced their DEI initiatives. IBM is not by itself. However, there is a different kind of exposure when a company is the first to be named in a False Claims Act settlement under the Civil Rights Fraud Initiative. This implies that all other federal contractors in the United States are now observing and reevaluating.</p>



<p>Here, the larger political context is important. The true nature of DEI and its functions are the subject of a real national debate. Civil rights activists have long maintained that these initiatives address actual, proven disparities in employment and advancement; without proactive intervention, preexisting prejudices worsen over time and some groups continue to be excluded. According to the Trump administration, tying bonuses to demographic results is not leveling the playing field but rather tilting it, and classifying employees based on race or sex is discrimination regardless of the direction it flows. That dispute is not settled by the IBM settlement. It merely proves that the government plans to take action on one side of the issue with real financial impact.</p>



<p>The False Claims Act mechanism itself is what makes the IBM case so compelling. The IBM settlement opens a door because the law permits private individuals, or whistleblowers, to file a lawsuit on behalf of the government and receive a portion of any recovery. It would be wise for other federal contractors to consider what their own staff members might report in addition to what the DOJ might discover. That is a completely different type of organizational risk calculation, and compliance teams nationwide are probably currently working through it.</p>



<p>It&#8217;s highly unlikely that IBM&#8217;s stock response—resolved, no admission, skills-first—is the final word on this. Although IBM&#8217;s circumstances are different, the company is still under constant scrutiny, as Guobadia stated he would continue to fight. It remains to be seen if the $17 million significantly alters IBM&#8217;s operations or if it merely signals the end of one chapter and the start of a more subdued, cautious approach to workforce management. It appears that the DOJ has discovered its model. The Civil Rights Fraud Initiative now has a named company, a settled case, and a monetary figure. Corporate America has been officially warned, especially any business with federal contracts.</p>

<p>When the <a href="https://creativelearningguild.co.uk/news/elisa-dasberg-remembered-the-life-behind-the-headlines/" type="post" id="2399">headlines</a> began to circulate more forcefully, traders in lower Manhattan were already looking at red screens: In a blog post, <a href="https://creativelearningguild.co.uk/tag/anthropic-ai/" type="post_tag" id="2416">Anthropic</a> described how its artificial intelligence (AI) tool, <a href="https://creativelearningguild.co.uk/finance/anthropic-stock-at-380-billion-valuation-the-next-tech-giant-or-peak-ai-hype/" type="post" id="6903">Claude Code</a>, could update COBOL systems more quickly and affordably than with conventional techniques. Within hours, IBM&#8217;s stock was plunging, closing at a loss of about 13%, the largest one-day decline in decades. Billions disappeared. And a blog was the catalyst for all of it, at least on the surface.</p>



<h4 class="wp-block-heading">When artificial intelligence is brought up, it&#8217;s difficult to ignore how brittle investor confidence gets.</h4>



<p>A large portion of the global financial system is still powered by COBOL, that obstinately robust <a href="https://creativelearningguild.co.uk/technology/south-african-tech-startup-develops-wearable-ai-that-translates-sign-language-live/" type="post" id="3589">programming language</a> from the 1960s. withdrawals from ATMs. reservations for airlines. The government gains. IBM Z mainframes, big, humming devices housed in temperature-controlled rooms in banks and government organizations worldwide, power a large portion of that code. Although these systems lack the glitz and glamour of Silicon Valley startups, they are reliable.</p>

<p>Anthropic&#8217;s assertion was simple. Claude Code was able to map dependencies, document complex workflows, analyze large COBOL codebases, and speed up modernization projects that had previously taken years. One gets the impression that the business wasn&#8217;t overstating its technical prowess. AI-assisted code analysis has significantly advanced. Workflows are increasingly being described by engineers in simple terms, and they are responding with working code. That feels authentic.</p>



<p>But in record time, Wall Street seemed to go from being a &#8220;helpful tool&#8221; to a &#8220;existential threat.&#8221;</p>



<p>The morning after the drop, the winter air outside IBM&#8217;s Armonk offices felt still. With coffee cups in hand and badges swiped, staff members talked about product roadmaps instead of stock charts. Teams were probably reviewing ongoing modernization projects inside conference rooms. IBM&#8217;s Watsonx Code Assistant has been providing AI-assisted COBOL migration tools for years. Within those walls, the notion that AI could aid in the reworking of legacy systems is not new.</p>



<p>Investors appear to think that abandoning IBM&#8217;s mainframes is inevitable if learning COBOL becomes inexpensive. It might be too neat of an assumption.</p>



<p>Language translation is rarely the only step in modernizing enterprise software. Syntax is addressed when translating COBOL into Java or another contemporary language. Data migration, performance assurance, regulatory compliance, and decades of embedded business logic are not all automatically resolved by it. Deeply integrated workflows that have been fine-tuned, optimized, and stress-tested over time are being executed by a mainframe that processes billions of encrypted transactions every day.</p>



<p>Whether AI can handle that full load is still up in the air.</p>



<p>The distinction between code analysis and infrastructure replacement is another deeper level of the IBM COBOL Anthropic controversy. Mainframes provide exceptional throughput, integrated security, and high uptime. IBM has highlighted that its most recent systems are capable of handling massive amounts of AI inference workloads and processing tens of billions of transactions daily. It&#8217;s ironic that the AI wave that seems to be threatening IBM may actually make the case for maintaining robust on-premise systems near mission-critical functions.</p>



<p>As we watch this play out, it seems like the market responded more to narrative than to subtleties.</p>



<p><strong>Speed is embodied by Anthropic. This AI startup moves quickly, releasing updates and whitepapers at the speed of Silicon Valley. <a href="https://creativelearningguild.co.uk/tag/ibm/" type="post_tag" id="2955">IBM</a> is a symbol of continuity. It caters to organizations that measure risk differently than venture capitalists, such as banks, <a href="https://creativelearningguild.co.uk/global/why-iran-attack-dubai-inside-tehrans-calculated-message-to-washington/" type="post" id="6952">governments</a>, and insurers. Usually, blog posts are not enough to influence these customers. Before making changes to infrastructure that handles cross-border transactions or national payrolls, they proceed cautiously, testing and validating.</strong></p>



<p>IBM is not exempt from this. Engagements involving a lot of consulting may decrease if AI technologies shorten the early discovery stage of modernization from months to days. Systems integrators might experience pressure on their prices. There may be minor but significant changes in the economics of legacy transformation. In the long run, it might be more beneficial to lessen the friction around mainframes than to replace them.</p>



<p>This episode, in a sense, offers a more comprehensive insight into the psychology of the market today. AI is expected to overthrow all incumbents, according to investors. Occasionally, that assumption turns out to be accurate. In other cases, it goes beyond reality. That tension seemed to be reflected in the IBM stock chart, which plummeted on a Monday afternoon as engineers silently continued to provide shipping updates.</p>



<p>The unsettling reality is that even though AI-generated code is amazing, mistakes are still made. Research comparing code written by humans and machines frequently reveals that AI produces more errors, especially in complex systems. A bug is annoying for a consumer app. It can be disastrous for a bank that processes billions of transactions. Even if it doesn&#8217;t become popular on social media, that distinction is important.</p>



<p>Compared to the market&#8217;s initial response, the tone of conversations with analysts and enterprise architects seems more measured. Many contend that IBM&#8217;s tools and Claude Code could coexist and even enhance each other. A combined ecosystem, with AI models speeding up discovery and IBM infrastructure guaranteeing dependability, seems more realistic than a winner-take-all situation.</p>



<p>In the end, the IBM COBOL Anthropic conflict might be more about acceleration than displacement. AI is shortening timelines, reducing some expenses, and posing new queries regarding how businesses handle aging infrastructure. But it&#8217;s rarely as easy as rewriting code to destroy foundational infrastructure.</p>



<p>The 13% decision on Wall Street appeared to be final. The real world is probably messier, slower, and much more incremental.</p>
