Although he is a Costco member, Russell George rarely uses his membership. That’s not out of the ordinary; many people enroll, go through a phase of purchasing 48 rolls of paper towels all at once, and then progressively stop making the trips to the warehouse while the yearly renewal process continues in silence. The distinction is that George claims that if he had been given a fair chance, he would have canceled his membership when it came time to renew it. Rather, his credit card was charged $65, the notice was sent sixty days prior to the charge, and the result was a class action lawsuit that Costco is currently required to respond to in court.

Although the legal matter appears technical at first glance, it isn’t. The Automatic Renewal Law of California, which went into effect in July 2025, establishes a window of time within which businesses must give customers notice before charging them for annual renewals: no earlier than 45 days and no later than 15 days. By that calculation, sixty days are out of the window. It’s too early. According to the complaint, Costco’s standard email notice, which arrives two full months before the card is charged, is “untimely and deficient” and denies customers the opportunity to take action before it’s too late. The time to cancel is long gone by the time the charge actually shows up.

When you consider it at scale, this type of case appears small. There are about 130 million Costco cardholders worldwide, and a sizable percentage of them reside in California. The renewal process operates automatically; an email is sent, a charge is made, and the majority of members either don’t notice the charge until they check their bank statement or don’t want the membership enough to care about it. The law being used here is specifically intended to stop that autopilot and require a brief period of real consumer choice prior to the money being transferred. It’s not that Costco failed to send a notice that George is complaining about. Sending one sixty days out, which is well past the point at which a member would consider taking action, serves more as a formality than a true warning.

Key Information: Costco Auto-Renewal Class Action Lawsuit

Costco faces class action lawsuit over membership auto renewal notices

Alleging violations of California’s Unfair Competition Law, Consumer Legal Remedies Act, and False Advertising Law, the lawsuit also targets Costco’s cancellation policies. Companies must permit customers to cancel using the same method they used to enroll in order to comply with California law, which presents a unique challenge for Costco. Memberships can be bought online, but at the moment, cancellations must be made in person at a warehouse or by calling a toll-free number. This kind of discrepancy is what consumer protection law was designed to address for a member who signed up with a few clicks at midnight and simply wants to discontinue the arrangement without having to drive to a big-box store in a strip mall off the freeway or navigate a phone tree.

It’s important to note that this case comes after a much larger federal effort to address this issue nationally. A rule that would have required businesses to make cancellation as easy as enrollment—if you can sign up with one click, you should be able to cancel with one click—was finalized by the Federal Trade Commission during the Biden administration in 2024. Additionally, it would have mandated recurring charge confirmation notices and yearly reminders. The rule was supported by a vast amount of consumer complaint data and had simple logic. In July 2025, it was overturned by a federal appeals court. The Costco lawsuit serves as a test of how seriously courts will enforce the patchwork of state laws that remain in its absence, with California having some of the strictest.

For its part, Costco has not made a public response to the complaint. The case is still very early because a preliminary hearing is set for June. It’s still unclear how Costco will build its defense, whether the court will certify the class, and how broadly George’s attorneys will define the covered membership population. The legal question could be shifted to whether “early” notice is functionally equivalent to no notice when the timing compromises the consumer’s ability to act. One possible argument is that sixty days’ notice is preferable to the legally required forty-five—more advance warning, not less. That’s a really intriguing legal question, and neither side is clearly losing.

As this case progresses, it seems to fit into a much broader discussion about subscription and membership businesses and the friction they purposefully create for cancellation. By all measures, Costco is not a bad actor; its membership satisfaction ratings are genuinely high, and most retailers would be envious of the company’s cultural reputation for treating customers fairly. However, whether Costco is a good company isn’t really at issue in the auto-renewal lawsuit. It concerns whether the renewal system’s mechanics satisfy a particular law’s requirements. The sixty-day notice window might be more difficult to defend on those more restrictive terms than it first seems.

The lighting is industrial fluorescent, the concrete floors are harsh, and finding the peanut butter requires navigating a maze of pallets. Millions of Americans, however, willingly pay for the right to shop in a warehouse on any given Saturday. Costco is more than just a store; it’s a subscription to an abundant lifestyle, where rotisserie chickens are still notoriously, boldly $4.99 and toilet paper comes in 30-roll boxes. However, the cost of admission increased recently. The price of a Gold Star membership increased to $65, and the coveted Executive tier reached $130, for the first time in seven years. The question of whether the religion of bulk is still worth the cover price is relevant in a time when every subscription service, from Netflix to Amazon Prime, is making it harder for us to pay.

Wholesale math is misleading. It entices you with the promise of discounts per unit, but it requires a large initial outlay of funds for both the membership fee and the cart total. The cost increase, according to critics, is the last straw for urban people or smaller houses with little storage. Saving three dollars on a gallon of mayonnaise isn’t a success if you live in a 600-square-foot apartment; rather, it’s a storage dilemma.

Costco Membership Price Hike: Is It Still Worth It?

But to focus solely on the membership’s sticker price is to overlook Costco’s business model’s strategic brilliance. It works more like an inflation insurance policy than a grocery shop does. Costco has mostly maintained supply while traditional stores have subtly reduced package sizes—the “shrinkflation” phenomena, in which your cereal box gets thinner but the price remains the same. The company’s secret weapon is the Kirkland Signature brand, which includes anything from golf balls to vodka. In blind tasting testing, it routinely performs better than branded brands and is far less expensive. Many loyalists find that the savings on a small number of Kirkland products, such as coffee, batteries, and allergy medication, cover the full $65 cost in a few trips.

When I saw a man excitedly tell a stranger that he had saved $200 on Michelin tires while I was waiting in line at the tire center last Tuesday, I came to the realization that, for one kind of customer, Costco is more than just a chore—it’s a sport.

However, the Executive Membership is where the true calculation is found. It seems high at $130. However, a 2% yearly incentive on purchases is provided by this tier. Approximately $3,250 in annual spending, or $270 per month, is the break-even point. Families find it surprisingly simple to get over this barrier. The cheque that Costco provides you at the end of the year usually covers the full membership price. You can even add a vacation package, a new laptop, or a couple tanks of gas (which are frequently 30 cents less per gallon than the station down the street). It’s a difficult loyalty cycle to escape.

But the castle is beginning to show signs of weakness. Renewal rates have slightly decreased, according to recent financial reports, especially among younger, digitally native members. This group is used to the subscription economy’s flexibility—sign up, binge, then cancel. For a generation accustomed to monthly flexibility, Costco’s strict yearlong commitment seems outdated. Additionally, for people who don’t want to purchase 12 pounds of ground beef at once, the emergence of “dupe” culture and bargain stores like Aldi present a strong option.

The “Costco Effect”—impulsive purchases that increase your receipt—should also be taken into account. You come in for milk and eggs and leave with a bag of churro-flavored almonds, a 75-inch TV, and a kayak. Only if you have the self-control to follow your list will you see the savings. The membership fee increase may have the unintended benefit of making you more frugal.

In the end, trust is more important to Costco’s 2026 value than numbers. The warehouse’s constancy provides a sense of security in a retail environment characterized by volatility and dynamic pricing. It is still $1.50 for the hot dog. Samples are still available for free. The membership feels like one of the last genuine offers in America, even at $65.

The rotisserie chicken rests under bright warming lights, wrapped in glossy plastic, emanating that familiar smell that swirls toward shoppers like incense. For years, it has been Costco’s amazingly successful emblem of bargain — stable in price, incredibly predictable in flavor, and shockingly low in an era of growing grocery expenditures. It is currently at the heart of a case that poses the straightforward query, “What does “no preservatives” actually mean?”

In recent days, a potential class-action case filed in California has disputed the labeling of Costco’s Kirkland Signature rotisserie chicken. Two shoppers say that signs and marketing stating “no preservatives” clash with the ingredient list, which includes sodium phosphate and carrageenan — chemicals frequently used to maintain moisture and stabilize texture during cooking.

Costco has admitted to utilizing those substances. Additionally, the business deleted the phrase “no preservatives” from some products, citing a need for uniformity in labeling. That action alone implies that the problem is serious. In consumer law, consistency is everything.

Costco Rotisserie Chicken Lawsuit Could Redefine Food Labeling Rules

The lawsuit contends that customers relied on clear, prominent messaging. According to the complaint, the plaintiffs allege they either would not have purchased the chicken or would have paid less had they known about the chemicals. They are requesting greater class certification and damages, which may apply to clients all around the United States.

The irony is hard to miss. The rotisserie chicken has long been held up as Costco’s moral anchor — a $4.99 constant while inflation reshapes food budgets. During economic upheaval, families flock toward stable essentials. That chicken, spinning gently beneath heat lamps, has been a particularly valuable ally for weeknight meals and tight salaries alike.

Over the past decade, food labeling scrutiny has considerably improved. Consumers pay closer attention to ingredients. They debate emulsifiers on social media. In internet forums, they discuss carrageenan. Concerns about chemicals are very similar across areas – parents, athletes, retirees, all inquiring what exactly they’re bringing home for dinner.

Sodium phosphate and carrageenan are permitted by regulators and commonly used in prepared foods. They appear in deli meats, dairy goods, and shelf-stable items. From a regulatory standpoint, they are permitted. From a marketing standpoint, however, nuance important. “No preservatives” communicates something incredibly straightforward to the common customer, even if the scientific definition is more complicated.

Midway through reading the complaint, I found myself wondering about how frequently I’ve rolled past that display without hesitating. You are drawn in by the scent. The pricing reassures you. The reputation of the brand takes care of the rest.

For Costco, the rotisserie chicken serves like a beacon – directing shoppers deeper into the warehouse. Executives have openly admitted that they maintain the price low even when profits are thin. It’s a loyalty builder, very successful at luring repeat visits. If the lighthouse flickers, even slightly, the brand feels it.

The greater context is crucial. Supply chains broke down and customer confidence faltered during the pandemic. Companies have relied significantly on transparency ever since. The labels are bigger. Ingredient disclosures are more thorough. Governments have pushed new front-of-package warnings in various places, signifying saturated fat, sugar, or sodium. In response, customers have become more watchful.

Although the outcome of this lawsuit may depend on legal definitions, it also touches on a deeper societal expectation: that ingredient lists and marketing language should match with extreme precision. When the two drift apart, skepticism grows.

The plaintiffs’ stance does not suggest that the chicken is hazardous. It claims that the messaging was misleading. That distinction is important. Trust, once dented, can be substantially slower to rebuild than profits.

Costco’s fast withdrawal of the claim may be particularly innovative from a reputational standpoint. The corporation changed its messaging instead of publicly suing. It’s unclear if such action will reduce liability, but it shows that clarity is a very useful currency in retail.

Today’s shoppers act like a swarm of bees in the grocery aisles, moving in unison toward signals of value, simplicity, and purity. A statement such as “no preservatives” behaves like nectar. Remove that nectar, or expose it to be something somewhat different, and the swarm recalibrates.

However, perspective is crucial. Millions of people still depend on the rotisserie chicken. In 2023 alone, Costco reportedly sold over 137 million chickens. That scale represents something markedly enhanced in the company’s operating strategy: vertically integrated chicken production, controlled supply chains, and very efficient distribution.

The lawsuit is not a vote on taste. It is a conversation about labeling precision. Precision becomes incredibly enduring protection against legal danger in a world where customers examine every claim, from “organic” to “natural” to “free from.”

In the next months, the court will consider whether the case moves as a certified class action. If it does, the way retailers phrase such statements may change. If it doesn’t, the episode might nevertheless have an impact on marketing teams in the sector, simplifying processes and reconsidering word selections before to signage.

Under the lights, the rotisserie chicken will continue to rotate. Shoppers will keep lining up, carts shoving forward. But something subtle has shifted.

Instead of being punishing, the lesson seems to be forward-looking. Transparency, when embraced early, is extremely successful. Clear language promotes confidence. And when brands choose clarity over creativity, trust is not just kept – it is substantially reinforced.

In a grocery scene marked by rising prices and strict budgeting, that kind of trust may be far more important than any single bird behind heated glass.
